~foodster~ is a service that provides a food ordering and delivery platform operated by Whos Hungry Ltd ("we" or "us" or "our" or "~foodster~"), incorporated and registered in England and Wales. Our Registered office is at 81A Katherine Road East Ham, London, E6 1EW, United Kingdom and our company registration number is 09468819.

What We Do

We provide a medium to place orders via web, mobile and telephone. We work in conjunction with several renowned independent restaurants and chains. It's simple, we arrange for your selected order to be prepared by the restaurant of your choice and then our independent delivery drivers also known as the "Hungermen" deliver it at your door step.

Order

An order can be placed using any of our above mentioned platforms. Once an order is placed it will be sent to our server and the relevant restaurant simultaneously and we will then confirm safe receipt of your order. For peace of mind, a confirmation email will be sent to you with the order and delivery details. Please note that we shall not process your order until you have received the confirmation email.

Payment

We offer online and cash payment upon delivery. All the prices are listed on our website and they exclude the delivery and transaction charge. Such charges will be clearly displayed in your order basket before we take any payment.

Delivery

Delivery will be made to the address specified by you when you register on our website. We do have the right to restrict deliveries in certain areas. Although we try our best to ensure that your complete order is delivered, in the event that your delivery has missing items please contact our order line so that we can rectify any errors and if relevant compensate you for them. A standard delivery charge of 0.99p applies to every single order. If one of our hungermen drivers arrive at your designated address and you fail to answer within 10 minutes, we reserve the right to leave and you will be still be charged for the order.

Cancellation and Returns

If an order is placed and you receive the confirmation email, you cannot cancel the order under any circumstances and we cannot provide a refund. However, in the event that you require a minor amendment to your order please ring our order line and we will try to contact the relevant restaurant to process any changes. However, we provide no guarantee that your request will be entertained.

Refund

Subject to our agreement, any approved refund will be reimbursed to you via the same medium used to make the initial payment.

Availability

All food is subject to availability and the orders will only be delivered to areas listed on our website.

Pricing

Prices listed on our website may vary and can change anytime but will not affect orders already placed and confirmed. We only accept pound/sterling (£).

Privacy Policy

At ~foodster~ we do not share or forward your data to any third party. Your details shall be handled with complete confidentiality. This includes all partner restaurants that we work with. We are the communication channel between the customer and the restaurant in case any party needs to be contacted.

Errors

Any identified errors throughout this process shall be rectified or compensated subject to our review and approval.

Liability

All the restaurants and meals listed on our website are regulated and tested. We promise high quality food and service. However the restaurant themselves will be fully liable for quality standards and any losses claimed pertaining to the quality of the food. Our liability lies to the extent of taking orders, processing payment and arranging delivery.

Conditions of use

All our customers must register before utilizing our service. We reserve the right to revoke, cancel your membership at any given time and your address may be black listed for future orders. We also reserve the right to take legal action should this become necessary.

Unforeseen Circumstances

There are some circumstances beyond our control such as traffic, weather, accidents and breakdowns (non-exhaustive list) which may affect our delivery targets but we will endeavor to deliver your food promptly and you will be notified of any circumstances affecting your order within reasonable time.

Revision

We reserve the right to amend our Terms and Conditions and our Website at any time without giving you notice. We suggest that you ensure that you keep up to date with any potential amendments.
